1. Acceptance of Terms

By accessing or using Ampcast ("the Service"), operated at ampcast.fm and dashboard.ampcast.fm, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Ampcast is a video podcast publishing platform that allows you to upload video content and distribute it across multiple platforms including YouTube, Transistor.fm, Spotify, and open podcast apps. The Service includes automatic audio extraction, HLS encoding, and unified analytics.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. The Service currently requires a beta invite code for registration.

4. Your Content

You retain ownership of all content (video, audio, images, text, metadata) that you upload to Ampcast. By uploading content, you grant us a limited license to store, process (including audio extraction and HLS encoding), and transmit your content to the third-party platforms you have connected, solely for the purpose of operating the Service.

You represent that you have the right to upload and distribute all content you submit, and that your content does not violate any third party's intellectual property rights or any applicable law.

5. Third-Party Platform Integrations

The Service integrates with third-party platforms (YouTube, Transistor.fm, Spotify/Megaphone). Your use of these integrations is also subject to the respective platform's terms of service:

Ampcast is currently in beta. We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify you of significant changes.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Termination

You may delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your content will be deleted in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Ampcast and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms.
